HANKIQ TERMS AND CONDITIONS
EFFECTIVE DATE: FEBRUARY 19, 2026
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE HANKIQ PLATFORM. These Terms and Conditions ("Terms") are entered into by and between you and Aespi Limited ("Aespi", "we", "us", or "our"), a New Zealand company. These Terms govern your access to and use of www.HankIQ.com, any subdomain of such website, the HANKIQ mobile application, and all related progressive web applications (PWA) (collectively, the "Platform"), including any content, functionality, products, and services offered on or through the Platform. BY ACCESSING OR USING THE PLATFORM, OR BY CLICKING TO ACCEPT THESE TERMS, YOU ACCEPT AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY, INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE PLATFORM.
1. Eligibility and Registration
You must be at least 18 years old to use the Platform. By registering an account, you represent and warrant that you are 18 years or older. If you are under 18 years old, you may not make a purchase or provide any personal information to us. You agree to provide accurate, current, and complete information when creating your account ("Account"), including your name, phone number, email address, and payment information. You agree to maintain and promptly update this information to keep it accurate and complete. You are solely responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account.
2. Service Description
HankIQ provides a comprehensive home and vehicle maintenance documentation and inventory management platform that includes:
- Maintenance scheduling tools with suggested maintenance tasks (provided as recommendations only)
- Photo documentation and timestamped evidence capture capabilities
- Inventory database with ability to upload photos, receipts, and documents
- Insurance policy sub-limit and per-item limit tracking and alerts
- AI-powered maintenance schedule checking and grading service ("HankAI")
- Generation of substantiation reports from your data
The Platform uses a privacy-first, local-first data architecture with progressive web applications (PWA). All user data is stored locally on your device and with your chosen cloud backup provider. We do not have access to your data and cannot restore it if lost. You are solely responsible for maintaining proper backups and data security practices.
3. Subscription Plans and Pricing
3.1 Subscription Types
The Platform offers various subscription options, which may include:
- Individual subscriptions for single properties, vehicles, or contents
- Bundled subscriptions covering multiple categories
- Monthly or annual billing options
3.2 Pricing and Payment
Current subscription pricing is available at www.HankIQ.com/pricing and displayed during the subscription checkout process. Prices are shown in U.S. dollars (USD) unless otherwise indicated for your jurisdiction.
By subscribing, you authorize us to charge your selected payment method for the applicable subscription fee displayed at checkout, plus any applicable taxes, duties, or fees required by law.
We reserve the right to modify subscription pricing at any time. Price changes for existing subscribers will not take effect until the start of the next billing cycle following at least thirty (30) days' notice via email or account notification. You may cancel your subscription before the new pricing takes effect if you do not wish to pay the modified price.
3.3 Payment Terms
We accept credit cards (Visa, MasterCard, American Express, Discover), debit cards, and ACH direct debit.
IMPORTANT: YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW ON A MONTHLY OR ANNUAL BASIS (DEPENDING ON YOUR SUBSCRIPTION TYPE) UNLESS YOU CANCEL AT LEAST THREE (3) DAYS BEFORE THE END OF YOUR CURRENT BILLING PERIOD. WE WILL CHARGE YOUR PAYMENT METHOD FOR THE RENEWAL AT THE THEN-CURRENT SUBSCRIPTION RATE UNLESS YOU CANCEL IN ADVANCE.
4. Free Trial
New users may be offered a 7-day free trial, which may be extended for an additional 7 days (total 14 days) if you meet minimum weekly data entry requirements and provide feedback supporting the program. To continue using the Platform after your trial period, you must subscribe to a paid plan before the trial expires. If you subscribe through the PWA app before the extended trial period ends, that subscription date will become the start of your paid subscription. IF YOU DO NOT SUBSCRIBE BEFORE YOUR TRIAL PERIOD EXPIRES, YOUR ACCOUNT WILL BE TERMINATED AND YOU WILL IMMEDIATELY LOSE ACCESS TO YOUR DATA. NO 14-DAY ACCESS PERIOD OR DATA EXPORT FACILITY WILL BE PROVIDED FOR EXPIRED TRIAL ACCOUNTS.
5. Cancellation and Refunds
You may cancel your subscription at any time through the user portal or by contacting us at info@HankIQ.com. Cancellations must be submitted at least three (3) days before the next billing cycle to avoid being charged for the next period. No Refunds: All subscription fees are non-refundable. If you cancel a monthly subscription, you will receive no refund for the current month. If you cancel an annual subscription, you will receive no refund or pro-rated amount for the remaining term. You will retain access to the Platform until the end of your current billing period. There is no cost to cancel your subscription. Upon cancellation, your subscription will not renew, but you will continue to have access to the Platform through the end of your paid billing period.
6. Data Access After Termination or Cancellation
Following cancellation or termination of a paid subscription (excluding trial accounts), you will have access to your data through the PWA app for:
- Fourteen (14) days from the date of termination by us, OR
- Thirty (30) days from the date you submit a cancellation request
During this period, you may export your data. After this period expires, your data access will be permanently removed. Because we use a local-first data architecture, we cannot restore your data. You are responsible for exporting and backing up your data during the access period. Trial accounts receive NO post-expiration data access or export facility if the trial expires without conversion to a paid subscription.
7. Loyalty Rewards Program
Any Loyalty Rewards Program ("Loyalty Program") established by the Company will only be offered in select jurisdictions. Availability, eligibility requirements, and benefits vary by jurisdiction as specified in the Loyalty Rewards Program Terms and Conditions for that jurisdiction. You must separately register for the Loyalty Program to receive any benefits. Benefits, eligibility requirements, minimum usage limits, earn-out periods, and all other terms governing the Loyalty Program are set forth in the applicable Loyalty Program Terms and Conditions for your jurisdiction. Loyalty Program benefits vary by jurisdiction and may include services, benefits, or other enhancements not available to non-Loyalty members. Registration for the Loyalty Program does not automatically entitle you to benefits; you must meet all requirements specified in the applicable Loyalty Program Terms and Conditions.
8. User Content and Data Ownership
8.1 Your Content
You retain all ownership rights in any content you upload, input, or create through the Platform ("User Content"), including photographs, documents, receipts, maintenance records, inventory data, and AI-generated content created from your prompts ("AI Output"). You represent and warrant that you own or have all necessary rights to submit your User Content and permit its use as contemplated in these Terms. To the extent that AI Output is capable of copyright protection, you own such rights upon creation, subject to applicable law.
8.2 Limited License to HankIQ
By submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and display your User Content solely as necessary to:
- Operate and provide the Platform and its features
- Process User Content through third-party AI service providers to generate AI Output
- Maintain backup, diagnostic, and security systems
- Comply with applicable law or enforce these Terms
We do not use your User Content or AI Output to train or improve third-party AI models.
8.3 Data Storage and Backup
Because the Platform uses a local-first data architecture, your data is stored on your device and your chosen cloud backup provider. We do not have access to your data and cannot restore it if lost. You are solely responsible for maintaining proper backup practices and ensuring the safety of your data.
9. ARTIFICIAL INTELLIGENCE AND AUTOMATED SYSTEMS
9.1 AI Features
HankIQ may provide features that use artificial intelligence, machine learning, or other automated systems (collectively "AI Features"), which may be identified within the Service as "Hank", "HankIQ","HankAI" or similar designations. Use of AI Features is optional.
9.2 Purpose and Scope
AI Features are designed to provide general information, insights, suggestions, analyses, and recommendations related to home maintenance, property management, asset tracking, insurance claims preparation, and related home management tasks.
9.3 No Validation or Guarantee
AI-generated outputs, including maintenance schedules, task recommendations, analyses, valuations, or other content: Are generated by probabilistic systems and may be inaccurate, incomplete, outdated, or incorrect. Have not been verified by qualified professionals. Do not account for all relevant factors including manufacturer specifications, regulatory requirements, site-specific conditions, or policy terms. Are provided as general guidance only and do not constitute professional, legal, financial, insurance, engineering, maintenance, or safety advice.
9.4 User Responsibility
You acknowledge and agree that: You must independently verify all AI-generated information before relying on it or acting upon it. You are solely responsible for all decisions and actions taken based on AI outputs. You will take appropriate safety precautions when performing any maintenance or project work and not rely solely on AI-generated guidance. Use of AI Features and reliance on AI-generated content is entirely at your own risk.
9.5 Intended Use Only
AI Features are intended solely for home management and related purposes. HankIQ is not responsible for any attempt to use AI Features for purposes outside this intended scope.
10. Prohibited Uses
You agree not to:
- Use the Platform in any way that violates applicable laws or regulations
- Reverse engineer, decompile, or disassemble any portion of the Platform
- Attempt to gain unauthorized access to the Platform or related systems
- Upload false, inaccurate, fraudulent, or misleading information
- Upload content that infringes intellectual property rights or violates any third party's rights
- Introduce viruses, malware, or other harmful components
- Use the Platform to harm, exploit, or endanger minors
- Use automated tools (robots, spiders, scrapers) to access the Platform
- Share your Account credentials with others or allow others to use your Account
11. Intellectual Property Rights
The Platform, including all content, features, functionality, software, code, design, text, graphics, logos, and trademarks (excluding User Content), is owned by Aespi Limited and is protected by New Zealand, United States, and international intellectual property laws. HankIQ, the HankIQ logo, Certified Log, and related marks are trademarks of Aespi Limited, registered in New Zealand. Unauthorized use is strictly prohibited. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial purposes only. You may not reproduce, modify, distribute, or create derivative works from any part of the Platform without our express written permission.
12. Third-Party Services and Links
The Platform may contain links to third-party websites or integrate with third-party services. We do not endorse, control, or assume responsibility for any third-party content, products, services, or websites. Your use of third-party services is at your own risk and subject to their terms and conditions. We may display advertisements for home-related products and services. We receive no liability for advertiser actions, product quality, pricing, or privacy practices. We may receive commissions from advertisers based on your engagement with their sites. Once you leave the Platform, any data you provide to third parties is governed by their privacy policies and terms, not ours.
13. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, available at www.HankIQ.com/privacy-policy. By using the Platform, you consent to our privacy practices as described in the Privacy Policy.
14. Disclaimer of Warranties
THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that:
- The Platform will be uninterrupted, error-free, or secure
- Defects will be corrected
- The Platform is free from viruses or harmful components
- Content or information on the Platform is accurate, complete, or current
- AI-generated content or maintenance suggestions are accurate or suitable for your specific circumstances
Suggested maintenance tasks are provided as recommendations only and do not constitute professional advice. You are responsible for determining appropriate maintenance for your property and vehicles based on manufacturer specifications, professional guidance, and your specific circumstances. Your use of the Platform is at your sole risk. You are responsible for implementing appropriate data backup and security measures.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AESPI, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total aggregate liability arising out of or related to these Terms or your use of the Platform shall not exceed the amount you paid to us in subscription fees during the twelve (12) months preceding the claim, or One Hundred Dollars (USD $100.00), whichever is less. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so the above limitations may not apply to you to the extent prohibited by applicable law. In such jurisdictions, the Company's liability shall be limited to the maximum extent permitted by law.
16. Indemnification
You agree to defend, indemnify, and hold harmless Aespi, its affiliates, and their respective officers, directors, employees, contractors, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Platform; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party rights; or (e) any negligent or wrongful conduct by you.
17. Geographic Availability and Governing Law
The Platform is controlled and operated by Aespi from New Zealand. We make no representation that the Platform is appropriate or available for use in all locations. Access to the Platform from jurisdictions where the content or functionality is illegal is prohibited. These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to conflict of law principles. Any disputes arising out of or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of New Zealand. If you are accessing the Platform from outside New Zealand, you are responsible for compliance with local laws in your jurisdiction.
18. Dispute Resolution
18.1 Informal Resolution
Before initiating any formal dispute proceedings, you agree to contact us at info@HankIQ.com to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith within thirty (30) days.
18.2 Time Limitation on Claims
ANY CAUSE OF ACTION OR CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM MUST BE COMMENCED WITHIN SIX (6) MONTHS AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
19. Termination
We may terminate or suspend your Account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.
20. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Effective Date" at the top. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically. If you do not agree to the modified Terms, you must stop using the Platform and cancel your subscription.
21. Electronic Communications and Notices
By using the Platform, you consent to receive electronic communications from us, including emails, text messages, push notifications, and in-app messages. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. We may send you service-related communications, including maintenance notifications, account updates, subscription confirmations, payment confirmations, Loyalty Program updates, and other administrative messages. You cannot opt out of service-related communications.
22. Severability and Waiver
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable. No waiver by us of any term or condition shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
23. Entire Agreement
These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Aespi regarding the Platform and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
24. Assignment
You may not assign, transfer, or delegate these Terms or any rights or obligations hereunder without our prior written consent. We may freely assign or transfer these Terms without restriction. Any attempted assignment in violation of this section is void.
